Case Study: Expert Rebuttal Report in Bankruptcy-Related Legal Malpractice Dispute

Client Challenge
Counsel for a national law firm was defending against allegations of legal malpractice, breach of fiduciary duty, and aiding and abetting misconduct in connection with a media company’s bankruptcy. The plaintiff alleged that flawed legal representation contributed to unfair financing terms, mismanagement, and a total loss in business value. A key issue in the dispute was the reliability and objectivity of the opposing expert’s valuation, which overstated damages by several million dollars.

Our Role
FairValue Advisors was engaged to deliver an expert rebuttal report analyzing the company’s financial condition, capital structure, and projected performance. Our professionals conducted a forensic review of historical budgets, debt arrangements, and internal financial records. We assessed the opposing expert’s discounted cash flow analysis, identifying unsupported assumptions, speculative growth rates, and a lack of consideration for retained assets. Our report also addressed causation, reasonableness of financing terms, and the broader business context that preceded insolvency.

The Result
Our findings revealed that the company had been undercapitalized from inception and relied on highly speculative revenue projections that failed to materialize. We demonstrated that the opposing expert’s valuation was unreliable, failed to account for key risk factors, and did not establish causation between the law firm’s actions and the alleged loss in value. Our rebuttal supported the defense’s position with a clear, well-substantiated narrative that held up under scrutiny and clarified the true financial drivers behind the company’s failure.
